2. Key definitions

Consumer buyer — a natural person making a purchase outside the scope of their business activity.
Business buyer (B2B) — a legal entity or sole trader (OSVČ) making a purchase within their business activity.

3. Placing an order and concluding the contract

The purchase contract is concluded at the moment the buyer receives an order confirmation from the seller by e-mail. The seller may refuse to confirm an order if the goods are out of stock or there is suspicion of an age-restriction breach.

Age restriction

⚠️ Under Czech Act No. 65/2017 Coll., the sale of tobacco products and hookah tobacco is permitted only to persons aged 18 and over. By placing an order, the buyer confirms they are at least 18. The seller may require age verification.

4. Prices and VAT

All prices are stated in Czech crowns (CZK) including VAT (VAT rate — 21% on most goods). Prices for B2B clients are stated excluding VAT. The seller reserves the right to change prices; the valid price is the one shown at the time of ordering.

5. Delivery and transfer of ownership

Ownership of the goods passes to the buyer upon full payment and receipt of the goods. The risk of accidental damage passes at the moment the goods are handed over to the carrier.

6. Withdrawal from the contract (consumer)

The consumer may withdraw from the contract within 14 days under § 1829 of the Czech Civil Code. Detailed terms are in the “Returns and exchanges” section.

7. Tobacco products legislation

Hookah Market operates in full compliance with the following legal acts:

Act No. 65/2017 Coll. — on protecting health from the harmful effects of tobacco (ban on sales to minors, labeling requirements)
Act No. 353/2003 Coll. — on excise duties (tobacco excise)
EU Regulation 2018/574 — tobacco product tracing system (Track & Trace)
Directive 2014/40/EU — tobacco products directive (packaging warnings)

8. Liability and limitations

The seller is not liable for damage caused by improper use of the goods or use contrary to the instructions. Information on the health harms associated with tobacco use is provided on the product packaging as required by law.

9. Dispute resolution

The parties strive to resolve disputes through negotiation. If that is not possible, the consumer may turn to ČOI (www.coi.cz) for out-of-court resolution. The governing law is that of the Czech Republic.

10. Changes to the terms

The seller may amend these terms. The current version is always published on the website. Changes take effect upon publication.
